UPDATE: Sheriff Glenn Palmer said in an email his meetings with militants didn’t include Ammon Bundy, leader of the occupation.

BURNS – Leaders of the armed protesters holding the national bird sanctuary on Tuesday plan to push their anti-government agenda in Grant County, whose sheriff recommends the government give in to two of their key demands.

Sheriff Glenn Palmer said in a statement to The Oregonian/OregonLive that “the government is going to have to concede something” to end the occupation of the Malheur National Wildlife Refuge.

He said freeing a father-son ranching team from prison “would be a start. Sending the FBI home would be a start.” He referred to the FBI’s lead role in ending the refuge occupation.

“I just pray to God that cooler heads prevail and that no one gets killed,” Palmer said.

The sheriff’s endorsement of the militants’ demands stunned law enforcement officials, most of whom would not publicly discuss the matter.

Malheur County Sheriff Brian Wolfe, who has been helping in Burns, said Palmer’s position “doesn’t help the cause. If anything, it hampers the effort to end this.”

The Grant County community may not know the protesters are coming back. The advertising promoting Tuesday’s meeting makes no mention of Ammon Bundy or other occupation leaders. The meeting is set for 6 p.m. at the John Day Senior Center. Promotions urge local citizens to attend to learn about the Constitution and consider forming a Committee of Safety.

Such a committee was a key instrument used by Bundy to marshal local credibility in Harney County. Six citizens, including four ranchers, are now on the Harney County Committee of Safety, working closely with the refuge occupiers to unwind federal involvement in the county.

But LaVoy Finicum, an Arizona rancher who often speaks for the refuge occupiers, said that Ammon Bundy, his brother, and Ryan Payne planned to attend the John Day meeting. Finicum said he would attend too.

Finicum said he expected Bundy and the others to put on the same presentation they gave two weeks ago in the small Harney County community of Crane. There, attendees got lectures on the Constitution and reasons why local ranchers should renounce their federal grazing privileges.

Tad Houpt, the local businessman organizing the John Day meeting, didn’t return four telephone messages or respond to written questions about the developments.

He organized the first known foray into Grant County by the militants on Jan. 12.

Ryan Payne and Jon Ritzheimer, two leaders of the occupation, attended a lunch in John Day with about 10 local residents. Palmer was called to the lunch, but said he didn’t know ahead of time who was there.

He stayed for the lunch and then joined the group when it adjourned to meet in private at a nearby business.

Ritzheimer said that as the meeting ended, Palmer pulled out his pocket version of the U.S. Constitution.

He had the two militants autograph it, Ritzheimer said.

“We shared similar ideas about where we’re at” in the country, Payne said.

“The sheriff has a practical plan for helping unravel the federal government,” Payne said. He said the militants didn’t ask Palmer to provide sanctuary or any other help to the protesters. He said when Palmer asked if he should visit the occupiers at the refuge, he advised the sheriff he would have to do so independently of his public role since he wouldn’t have authority in Harney County.

Jim Sproul, a Grant County businessman who attended the meeting, said the protesters were “clean, nice, very informative.”

“What I took away from it is they’re no militants,” Sproul said. “They’re not terrorists. I think they are very patriotic.”

Two days or so after that lunch, Payne returned for a second meeting with Palmer. Other law enforcement officials said Ammon Bundy also met with Palmer, but the sheriff said in an email on Monday that “I never met with Ammon Bundy.”

County Judge Scott Myers said he was aware of the second meeting but Palmer has shared no details.

“I have no idea whatever what they’ve discussed,” Myers said.

Wolfe, president of the Oregon State Sheriffs Association, said the state’s other sheriffs are concerned with Palmer’s conduct. He said he asked Palmer for details about the meetings.

“All I’ve been told is they just wanted to talk to him,” Wolfe said. “He’s not shared any other details with us at all.”

Palmer declined interview requests and answered only a handful of more than two dozen written questions.

“I am not hiding anything,” he said in an email.

Palmer said in an email that he got a text message from Ammon Bundy around Jan. 10 asking him to come to the refuge. Palmer didn’t address how the militant had the sheriff’s cell phone number. Palmer said he advised Bundy he couldn’t make such a trip without clearance from David Ward, the Harney County sheriff. Palmer said he was advised not to go.

While he wouldn’t provide details of his subsequent meetings with the militants, Palmer said, “There are no and never has been any public safety concerns that would indicate that these people put our community at risk or in jeopardy.”

In Harney County, the protesters in November and December pressed Ward to create a sanctuary to stop the imprisonment of ranchers Dwight Hammond Jr. and his son Steven. They returned to federal prison Jan. 4 to finish sentences for arson convictions. The militants insisted Ward had a constitutional duty to protect the Hammonds from what they considered unlawful imprisonment.

Bundy and his men are likely to find a receptive audience in Grant County and with Palmer. County residents have grown increasingly restive about the slow pace of restoring logging on the Malhuer National Forest and have bristled at plans to close forest service roads.

Palmer is aligned with the Constitutional Sheriffs and Peace Officers Association, a national nonprofit which interprets the constitution to severely limit federal government powers. Palmer was the association’s first “Constitutional Sheriff of the Year” in 2011 and now serves on its advisory board.

He often speaks critically of the federal government, particularly the U.S. Forest Service, which is a major land owner in his county.

“The only thing that is out of control is the federal government,” Palmer said in a 2011 speech in California to a group considering constitutional issues.

“I am not a public employee. I am a public servant,” said Palmer.

He warned the audience that federal authorities were eroding water, mining and other resource rights.

“Don’t let them take them from you,” he said. “Stand up and defend for what you believe in.”

Palmer ended a joint policing agreement with the Forest Service because it wouldn’t submit to his authority.

“They have no constitutional authority” to perform police functions in Grant County, he said.

More recently, Palmer crafted a local plan that he believed mandated how the Forest Service could manage its lands. He said he needed local input to ensure he could protect the public and stop federal acts such as closing forest roads.

But the county’s attorney said Palmer misread the law and the Constitution.

“There is no authority in the U.S. Constitution, Forest Service legislation or the [management] rule that afford any priority to the sheriff’s plan,” attorney Ron Yockim wrote to county commissioners last October.

curious… haven’t heard anything about Glenn Palmer for a while… and the last two high profile arrests in John Day were by a deputy and by local (real) police.  Is he barricaded inside the county jail or something, “protesting” Sunlight Laws?

Hammonds have been on the wrong side of the law for a long time.  If they want to try to go for a pardon that is their choice.

Lost in all of this is the fact that the Hammonds’ plea deal they cut with federal prosecutors resulted in the 5 year federally mandated prison sentence. They were convicted by a jury trial and negotiated a deal to take other charges off the table. They were found guilty and were not railroaded. Congress (controlled by republicans in 1994) passed minimum sentencing guidelines and they judge, who originally let them off for time served and probation did not have legal authority to do so. If Palmer and others of his ilk don’t like it they can start electing politicians who will rescind these Draconian laws. I doubt that will happen anytime soon as most Mormons vote based on socially conservative platforms. Social conservatives are usually hardliners when it comes to mandatory prison sentences.

Burning the land there is normal. This is not some kind of unusual or even damaging thing. It is however, rather imprecise, as fire can be tough to guide.
Arson is a miscarriage of justice and shows the feds to be thoroughly immoral in dealing with people who have gotten in their way.

Start understanding that just because a bunch of tyrants calling themselves “public officials” deem something as “legal”, does NOT automatically make it Lawful, and vice versa. Just because THEY deem it “illegal” does NOT always mean it’s “unlawful”.

Most Americans don’t know SQUAT about law. They think law is law.  There’s Roman civil law, there’s maritime admiralty law, there’ the Uniform Commercial Code, natural law, and common law to name a few.

Someone answer me this,  if only attorneys licensed by the “Bar Association” can practice law in the courtrooms, do you have ANY real idea of what’s ACTUALLY going on when you or I are called on in court and on our way up the the spot we speak to the judge from, we physically cross the “Bar”  that exists in every courtroom?

Do you know WHAT KIND of law is being “practiced” in that courtroom? Do you know anything about the details of the adhesion contracts you’ve been entering into with the government your whole life and whose authority and jurisdiction you’re volunteering into via those contracts???

I bet there’s NOBODY on this entire page who can tell me accurately and correctly!!!

@Roni Sylvester That’s a crock.  The only claim it makes is that the Hammonds did not commit a crime (with the two separate fires that they started) because lighting those fires was a “reasonable exercise” of their property rights.  In most circumstances, this is probably true.  It was NOT true in the Hammonds case.

It is NOT a reasonable exercise of a person’s rights to try to use a fire to hide evidence of the commission of a felony (just as it is not a reasonable exercise of my rights to hide evidence of a crime in my home by flushing the drugs down the toilet).  Even IF poaching was not a factor, if you start a controlled burn on your property (for whatever reason), then it is your legal obligation to actually control that burn and prevent it from spreading to a neighbor’s property — you will be held liable for damage done to your neighbor’s property if you don’t.  Finally, though not technically a legal requirement, most neighbors will notify those around them that they intend to conduct a control burn.

With respect to having a legal property right to start a backfire on one’s property to fight another fire, most would also agree that this is reasonable.  But again, if there happens to be a fire crew fighting that fire on the adjacent property, and you have a history of arguing and fighting with the owner who has contracted with that crew, and the backfire that you start gives the impression of being threatening to the fire crew, then your “reasonable” claim comes into legal question.

@shays01 @Roni Sylvester  – “poaching?” Were they convicted of “poaching?” Please provide that court case. Was it entered into the 2015 trial?

Was “threatening to the fire crew,” proven? If so, in what court case and, were the findings entered into the 2015 trial?

Based on your lack on knowledge regarding federal land and grazing allotments, I’m assuming you’re not an allotment owner.

Using statutes as my basis, I repeat, the Hammonds were imprisoned for crimes they did not commit.

And, he’d just been blowing dope smoke all over my front porch. I spotted them coming up my walk and waited until they were just about to knock, to flush the toilet. “Did you flush it all?” I said, “Yep”. Case closed, and off to Eugene. @DerfyFred @Roni Sylvester – that’s inaccurate…The reports state 139 acres of federal land in one instance, and 1 acre in another. The Hammonds were Allotment Owners on all 140 acres…thus, the grass they burned was their own, and, Allotment Owners are exempt from burning on their allotments.

Nice job Grant County. By electing an extreme right wing nut-ball Sheriff who supports armed constitutional terrorists but won’t back up his fellow officers of the law in the next county, you have insured that your already depressed economy and property values will shrink even more in years to come. The chickens will be coming home to roost in the form of heavily armed crazy people, who will, thanks to your sympathetic Sheriff, undoubtedly flock to John Day as a safe haven for their extremist plots. Good luck attracting any new businesses, tourism,etc because no one will want to invest in a place where the laws of the land are not followed.

If the majority of counties in this country had a truly Constitutional sheriff like Glen Palmer, we wouldn’t have all the blatant violations of the Constitution that are going on left and right these days.

Unfortunately WAY WAY too many county sheriffs either don’t know or choose not to exercise the true Constitutional authority of their office.

So to say you have a problem with Glen Palmer or ANY OTHER sheriff like him, is literally to say you have a problem with THEE SUPREME LAW in this land. The Constitution itself.

If you have a problem with the Constitution perhaps you should consider moving to a country whose laws and political system are more to your liking!!

In a groundbreaking move, Texas Gov. Greg Abbott has called for an official “convention of the states” to finally put a stop to Barack Obama, and it’s gaining serious momentum. Not only does Abbott want to reign in Obama’s unconstitutional authority, but he has other proposals that just about every American can get behind.

Using Article V of our Constitution, Abbott plans to propose new amendments that would completely change the direction of our nation while restoring power back to where it belongs – to the people then the states, respectively. His plan would also give states the power to nullify a bad decision by the Supreme Court – something desperately needed in recent times – and get Congress completely out of the business of regulating things that happen inside a state’s borders.

On Friday, Abbott officially called for just such a convention to seize power from a federal government that is out of control and return it to the states. He called his proposed amendments “The Texas Plan.”

Some of the amendments in the proposal include prohibiting administrative agencies and the unelected bureaucrats from creating and preempting federal law; mandating that Congress balance its budget; allowing a two-thirds majority of the states to override a U.S. Supreme Court decision, federal law or regulation; and prohibiting Congress from regulating activity that occurs within one state’s borders.

Abbott argued that Obama has abused his presidential authority, and trampled on the United States Constitution.

“If this is allowed, the United States Constitution has been completely rewritten,” Abbott said in an interview with the Examiner.

“The United States Supreme Court is a co-conspirator in tearing down our Constitution, which is exactly why I am calling for a Convention of States so we can restore the Constitution to its original principles,” he added.

According to Abbott, his plan would force the federal government, which has run rampant with power usurpations, to “take the Constitution seriously again.” Believe it or not, his idea just might work as well, since there’s over 30 states that now have Republican leadership, and only 38 are needed to call a convention.

As of this writing, five other states have jumped on board with the idea. But with Abbott’s support, it’s bound to gain some serious momentum.

With the manner in which Obama has all but put the Constitution through a shredding machine, such a move is exactly what’s needed to get our nation back on the right course. After all, when we have a president ruling by executive fiat, a Congress that’s more symbolic than useful since it relegated its authority to unelected bureaucrats, and a Supreme Court that’s creating laws, rights, and policies from the bench, it definitely time for a reset.

As for school districts not being able to pay their teachers, the administration should be held accountable for their poor planning. How much did they have in the fund balance, how much of the payroll was going to those administrators versus the teachers, how much of the budget is being used for perks for the administration rather than going to teachers? When the legislature gave money for a pay increase, teachers went to Austin to lobby for the money to go directly to teachers and not the districts as the administration would increase their pay and teachers would get very little and that’s what the legislature did and the teachers got a $3000 raise.

Some drivers hooted and hollered Saturday in Bend as they drove by protesters, who raised American flags and signs questioning the federal government. About 100 people gathered on street corners early Saturday afternoon at NE Greenwood Avenue and Third Street in Bend to protest the death of Malheur National Wildlife Refuge occupier LaVoy Finicum.

The rally was planned from noon to 3 p.m., but at about 4 p.m., Bend Police Department and the Deschutes County Sheriff’s Office responded with several police cars to a report of a fight between Jacob Daniel Vincent, 24, and Jason Allen Schneider, 41, both of Bend.

Vincent was on the southwest corner of the intersection with a protest sign when Schneider stopped his car, blocking traffic, according to police. Vincent was not protesting directly in connection with the Malheur refuge event. Schneider got out of the car to confront Vincent, according to Bend Police.

Vincent poked Schneider with his protest sign, and the two started to fight. Schneider ran across Third Street, and Vincent chased him with a knife, but Schneider was able to keep his distance.

Schneider was cited for second-degree disorderly conduct and allowed to leave the scene; Vincent was arrested on suspicion of menacing and lodged at Deschutes County jail.

Most of the refuge protest was marked by horns honking and demonstrators cheering.

“Was anyone else out here out at the refuge?” one man shouted as he stood on the southwest corner of the intersection.

Bob Cain, 54, of Powell Butte, signaled that he had been to the occupation earlier this year.

Stepping forward, the man who asked the question shook Cain’s hand.

“Good man,” he said.

Cain, a third-generation Oregon rancher, said Saturday his father and their third partner at their 500-acre cattle ranch were “holding down the fort” so he could make it to the protest.

“We’ve got cows that are calving and first-time heifers that are calving,” Cain said.

Cain explained he had visited the occupation the day before Ammon and Ryan Bundy were arrested Jan. 26, the same day Finicum was fatally shot by an Oregon State Police trooper.

“I went over and saw what it was all about, and talked,” Cain said. “My goal was to go out there and support them.”

He felt media had misrepresented the residents of Harney County by portraying them as afraid.

“To me it was very slanted that everyone in Harney County was scared, and they were fearful,” said Cain. “People were carrying guns, but I never felt threatened or scared.”

Cain, who carried a gun Saturday, said he always has a concealed carry, but his intention isn’t to use a gun, unless one is used against him.

Cain’s visit to the occupation in late January led him into familiar territory — his grandfather ranched in Harney County, and his father ranched in Prineville before him. Cain believes his grandfather would have supported the discussion that’s happening now — about land rights and alleged federal government overreach.

“I think that my grandfather would be sad that it’s come to this,” Cain said. “He would hate to have to protest … He was a hardworking man and wanted what’s right.”

Donna Hammond, 58, of Crook County (of no relation to the Harney County ranching family) organized the Bend rally. She wore a blue plastic tarp as a makeshift cape in honor of Finicum, who was known for wearing the item during the occupation.

“There was a plea put out from the Finicum family to stand with LaVoy in the state capitals of every state in the nation today,” Hammond said. “Portland and Salem were both going to do one, and I just didn’t want to go over the mountain.”

At the rally Saturday, Hammond guessed the majority of people were Central Oregonians, though some may have come from other parts of the state.

“I felt there was enough people here that would like to stay right here and protest, so I stepped up and said ‘OK, I’ll organize it,’” Hammond said.

Hammond, who once owned a 160-acre ranch in Crook County, said she believes the issues protesters wanted to bring to light at the Bend rally aren’t ones just affecting ranchers.

“This is not a rancher issue, this is not a Hammond issue, this is not a Bundy issue; this is an American issue,” Hammond said, calling herself “your average citizen.” “We have a problem with our federal government overreaching.”

Holding a large American flag and sign, Bob Platt, 55, of Redmond explained why he decided to come out.

“Why am I here today? For the obvious reasons,” Platt said. “One man was shot to death by multiple bullets, I believe, and so do many others. We demand a thorough investigation on how many times LaVoy was shot.”

In early February, Platt, who has a horse logging operation, told The Bulletin he went to the refuge “with a Bible on the dashboard” of his truck. Platt said Saturday he’d like to know why law enforcement officials found it “necessary to set up an ambush on a rural road and lead (Finicum) into a trap.”

“My questions to them are: Are they just setting a precedent?” Platt said. “Are they just trying to inflict fear into the populace? Are we mere peasants being dictated to by a kind that we dare not rise up? What is the message that they’re trying to give us?”

I was asked by William C. Fisher if I would say a few words at the rally yesterday, I told him thanks but I am not one to talk in front of a crowd and especially unprepared. As all the phenomenal speakers were speaking it was really bothering me that I would turn down this opportunity to speak on this day of honoring LaVoy, so I decided to speak and figured my friend had sacrificed his life for what he believed so strongly on that I really needed to say some words on his behalf.
I don’t know what I sounded like up there but I am so thankful that I did go up there and not blow this opportunity to say some words for my Patriot brother LaVoy Finicum.
Thank you William for that opportunity, and thank you for all you did with organizing this event.

Levi Shaari Good move – most times, if you wait to be prepared, you lose an opportunity. WTG on holding the flat the way you did – I was actually called upon it at work (I wear the little window flag like that); “Oh, your flag is upside-down” the guard said. I told him “Yes, I know”, and he said it was ‘disrespectful’. I had to explain, and he STILL thought it was ‘disrespectful’. Not much of an IQ, the guy. Sad how many are ignorant of the FC.
