BLM Forms New Division of Security, Protection and Intelligence (S.P.I.)

The Bureau of Land Management has announced the formation of the new (and presumably heavily-armed) division of Security, Protection and Intelligence.  The new division is being created just months after Ammon Bundy led dozens of armed anti-federal-lands activists in seizing the unoccupied Malheur National Wildlife Refuge in Oregon.

It’s unclear to what extent the new BLM law enforcement post is connected to the Malheur incident or to the general rise in anti-federal-lands activity in the rural West.

This new department will operate independently of the already existing BLM Department of Law Enforcement and Protection under Director Salvatore Lauro, it will also operate independent of the Department of the Interiors (BLM’s mother agency) according to James Gallagher Director of Intelligence for the Department of Interior. In fact it is quite unclear as to who will have oversight over this new department or who authorized it’s creation.

In calls to BLM public affairs officers they were unaware of the creation of the new division. Contact with Oregon Representative Greg Walden’s office and Utah Senator Mike Lee’s office led to similar results. We are awaiting comment from individuals in those offices who have promised to contact the Shasta Lantern with further information.

Among our questions asked, other than who authorized S.P.I.’s creation are, how many agents will the new department entail, will the department be recruited from existing BLM employees or from other Federal Agencies, will this lead to a budget increase for BLM or will the department operate within current fiscal constraints, what is the overall stated mission of this new department, what form of training will agents receive to carry it out, who will train them, and lastly what intelligence with S.P.I. be collecting, who will they be collecting it on, how will it be collected and how will that intelligence be used?

BLM Officer Dan Love of Bundy Ranch and Blanding, Utah infamy

What we do know, is that at his own request, BLM Special Agent in Charge of S.P.I. will be none other than Officer Dan Love of Bundy Ranch and Blanding, Utah infamy.  A polarizing figure, Love is both loved and reviled in Nevada and Utah, where he was the BLM’s top cop.

In Nevada and Utah, Love led some of BLM’s most complicated law enforcement operations. Love was the lead agent in BLM’s two-year undercover investigation with the FBI nearly a decade ago into illegal Native American artifact trafficking in the Four Corners region that resulted in the arrest of more than two dozen people and the suicide of a well-respected local doctor. In 2008, Love arrested and helped prosecute environmental activist Tim DeChristopher for disrupting a BLM oil and gas lease sale in Salt Lake City that critics said imperiled Arches National Park and the climate. Love was also the lead agent at the Bunkerville Cattle Rustling incident when BLM unlawfully attempted to remove cattle belonging to Cliven Bundy.

Love’s appointment to this new role will certainly be viewed as an affront to many BLM detractors who claim BLM has far overreached it’s power and authority and view Love as the poster child for that sentiment.

First I want copies of their Oath of Office. Second the legislative Act of Congress creating this unit. Third their job description. These for starters. Does this mean they are actually doing war against the Government of this nation formed within the 1776, ratified 1778, Constitution for the United States of America? Acts of High Treason thereof? Whereas all government employees must perform their duties in support of this Constitution and protect the bloodline American failure to do so will cost them more than they know. So once you have sworn them, you are obligated to live by them, until you die, unless you want to become a traitor. And as a Marine, if you turn your back on the oaths, no Marine will want to deal with you.. … So please point out where you get “protect the blood line” from….. Oh, and if you are representative of what the BMI has to deal with, I can see why they would go to a heavy armed unit. The crazier and more violent people get, the response will be to get heavier and heavier armed…. And the government can always put more man power, and more armement into things than what crazy BMI protesters can.

To say these men are armed is am exaggeration . When people carry a rifle or some such in this area it is a form of living. An ak15 is not justified. If you carry one of those, you’re looking for trouble. There is a difference in having your rifle behind your truck seat (in the window) and under your seat. Different places, different things.

New images of cattle rancher Cliven Bundy’s tense standoff with the Federal Bureau of Land Management (BLM) on Saturday afternoon  reveal how the armed agency’s military operation configured to forcefully engage Bundy cowboys and their supporters who sought to liberate federally confiscated cattle over the weekend.

These exclusive images were taken by an independent photojournalist, positioned right above the action on the Southbound side of Interstate 15 near Bunkerville, Nevada.

Despite the BLM being instructed by Clark County Sheriff to leave the Bundy Ranch and Gold Butte area earlier that morning, the agency still insisted had a legal right to be there and that it would not let go of hundreds of cows it had already taken away from the Bundy Family. Critics are asking if that ‘legal right’ also includes stationing a federal military force in Bunkerville.

Prior to this standoff, the special agent in charge of BLM’s ground operations, Daniel P. Love, had issued a warning that any one who crosses the federal line in order to free the seized cattle – will be arrested.

Agent Love went on boasting his agency’s advantage over Bundy supporters when saying, “I’ve seen your numbers right now, you’d better hope that 10,000 show up.”

It turns out that protesters needed far less numbers to overcome Love’s federal detachment. In the end, a Bundy’s contingent of 150 cowboys on horseback and a few hundred of peaceful supporters – backed by approximately 100 volunteer militia, all together, proceed to march past the BLM’s line of demarcation to the entrance of the government’s makeshift cattle holding area and compound, prompting armed federal tactical teams to stand down, and fall back.

The following is the first collection in a three part series, showing what can only be described as the federal government’s ‘paramilitary’ build-up to Saturday’s climax under U.S. Interstate 15…

Wyoming Rancher Sticks It To The Feds…Wins Big Time Against Obama And The EPA

It might have lacked the drama of the Bundy ranch standoff in Nevada two years ago, and the bloodshed of a related militia occupation in Oregon last year, but a court settlement […] was a smashing victory for a Wyoming man fighting an ever more intrusive federal government.

And while the settlement won’t create a legal precedent, it’s a property rights victory for Americans throughout the country — a victory won by a young rancher and the Constitution-protecting legal team that stood with him.

The case that drew the attention of national news outlets pitted rancher Andy Johnson against the Obama administration’s Environmental Protection Agency and its overzealous agents who tried to fine Johnson millions of dollars for a pond he created on his own land, at his own expense, in Fort Bridge, Wyoming.

The battle started two years ago, when Johnson obtained a state permit to dam a small creek running through his 8-acre property, according to The New York Times. The pond that was created was not only a benefit to the Johnson’s ranch, to be used for watering his horses and cattle, it also became an attraction to wildlife. But the federal government decided Johnson hadn’t gotten the EPA’s approval for the project and was violating the Clean Water Act. It ordered him to dismantle the pond — on pain of fines reaching a ludicrous, business-killing $37,500 a day.”

With fines adding up to over $16 million, enter the Pacific Legal Foundation seeking to vindicate Johnson’s property rights with a lawsuit against the EPA. After two years of legal wrangling there is the sweet taste of victory to report. 

According to WND.com  the PLF has announced the Fed has agreed to resolve the case, and a federal court has put it’s stamp of approval on it. “Importantly, under the settlement, the Johnson family’s pond will remain; they won’t pay any fines; they don’t concede any federal jurisdiction to regulate their pond; and the government won’t pursue any further enforcement actions based on the pond’s construction,” …“This is a victory for common sense and the environment, and it brings an end to all the uncertainty and fear that the Johnson family faced,” said Jonathan Wood, a staff attorney with Pacific Legal Foundation.

The next family that finds itself in our situation, facing ominous threats from EPA, can take heart in knowing that many of these threats will not come to pass. BLM agent linked to deadly operations in Utah and Oregon takes broad new post

“In this position, Dan will be responsible for a range of national level program components including facility security oversight and coordination efforts, as well as the bureau’s law enforcement intelligence program,” BLM Office of Law Enforcement and Security Director Salvatore Lauro wrote Friday in an internal email obtained by Greenwire.

“While I know Dan’s leadership in Region 3 will be missed, I’m confident his skills and talents will serve us well in establishing and developing these critical national office programs,” Lauro wrote.

The new position was created months after Ammon Bundy led dozens of armed anti-federal-lands activists in seizing the unoccupied Malheur National Wildlife Refuge in Oregon. The January incident forced the Fish and Wildlife Service to move more than a dozen refuge staff outside of Harney County to ensure their safety. BLM and the Forest Service closed their offices in Harney, too, and had their employees telework for weeks.

One week into the occupation, police disconnected power to a BLM fire station in Frenchglen, a small community about 40 miles from Malheur headquarters, to ensure militants did not take it over, too.

It’s unclear to what extent the new BLM law enforcement post is connected to the Malheur incident or to the general rise in anti-federal-lands activity in the rural West.

BLM’s facilities also face threats from the left. The Keep It in the Ground movement, which seeks to end the leasing of oil, gas and coal from federal lands and waters, has staged nonviolent protests at several BLM oil and gas auctions over the past several months and has disrupted some sales with songs and physical blockades.

BLM spokesman Craig Leff said Love’s new post is not a response to any particular incident. It aims to ensure the security of BLM’s roughly 175 state, district and field offices as well as warehouses and fire caches, and to keep BLM employees and visitors safe, he said. It includes intelligence gathering on emerging threats, including from websites and social media.

Love will oversee a team of three, Leff said.

The deputy special agent in charge for Nevada and Utah, Zachary Oper, who is based in Nevada, will assume Love’s old post in an acting capacity until BLM finds a permanent successor.

Gavin Shire, a spokesman for the Fish and Wildlife Service, said no similar post exists at FWS, which manages more than 560 national wildlife refuges including Malheur.

In 2006, the agency created a branch for emergency management and physical security within its Division of Refuge Law Enforcement, Shire said. It includes the chief of emergency management and the agency’s physical security specialist.

“This branch manages everything from emergency support function call-outs for law enforcement and security under the National Response Plan to emerging issues (such as the Zika virus) to ensuring the service’s support of the national Continuation of Operation posture,” Shire said in an email.

Threats to federal land management facilities intensified in Nevada in the 1990s during a resurgence of the Sagebrush Rebellion, a movement by rural counties to assert local control over federal lands.

On Halloween in 1993, a bomb was hurled onto the roof of BLM’s state headquarters in Reno, which was unoccupied at the time. The blast severely damaged the building’s roof. In March 1995, a suspected pipe bomb was placed on the office windowsill of Forest Service District Ranger Guy Pence. The window was blasted out, but no one was injured.

Neither crime was solved.

In Nevada and Utah, Love led some of BLM’s most complicated law enforcement operations.

Love was the lead agent in BLM’s two-year undercover investigation with the FBI nearly a decade ago into illegal Native American artifact trafficking in the Four Corners region that resulted in the arrest of more than two dozen people and the suicide of a well-respected local doctor. In 2008, Love arrested and helped prosecute environmental activist Tim DeChristopher for disrupting a BLM oil and gas lease sale in Salt Lake City that critics said imperiled Arches National Park and the climate.

Sheriffs, county commissioners and Utah members of Congress said Love lacked the gravitas to handle the delicate politics of public land management in the rural West.

Allies said Love deserves credit for helping deter illegal looting and trading of artifacts from public lands and for ensuring nobody was injured or killed during the Bunkerville, Nev., standoff with Bundy.

“The biggest problem with Dan is nobody trusted him,” said Garfield County, Utah, Sheriff Danny Perkins. “It sounds to me that they gave him a better job than he had.”

Perkins added, “I think BLM has a lot of fence mending whether Dan is there or not. It looks like the ball’s in their court.”
